By creating an account or using Gradiuz ("Service", "we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.
Gradiuz is an AI-powered study tool that helps users generate quizzes, flashcards, and summaries from uploaded documents. Features are provided on a subscription or credit basis.
You are responsible for maintaining the security of your account and all activity that occurs under it. You must be at least 13 years old to use the Service. You may not share your account credentials with others.
Access to AI features requires an active subscription or credits. Subscriptions are billed in advance on a monthly or annual basis. Credits are non-refundable and do not expire. Payments are processed by Polar (our merchant of record). Subscription cancellations take effect at the end of the current billing period — you retain access until then.
We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.
Subscription fees are non-refundable except where required by law. One-time credit purchases are non-refundable once credits have been used. If you believe you were charged in error, contact us within 14 days.
You retain ownership of any documents you upload. By uploading content, you grant us a limited, non-exclusive license to process that content solely to provide the Service. We do not use your uploaded documents to train AI models or share them with third parties, except as necessary to provide the Service (e.g., sending text to the AI provider for processing).
You must not upload content that infringes copyright, contains illegal material, or violates the rights of others. We may remove content that violates these terms.
AI-generated quizzes, flashcards, and summaries may contain errors, inaccuracies, or omissions. They are provided as study aids only and should not be relied upon as authoritative sources. We make no warranties regarding the accuracy or completeness of AI-generated content.
You may not:
We may suspend or terminate accounts that violate these Terms, at our discretion and without prior notice for serious violations. You may delete your account at any time from your account settings. Upon deletion, your data is permanently removed.
The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
To the maximum extent permitted by applicable law, Gradiuz is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Italian law.
If you are a consumer resident in the EU, you have the right to withdraw from a purchase within 14 days without giving any reason (D.Lgs. 206/2005 – Codice del Consumo). However, by expressly requesting immediate access to the digital Service upon purchase, you acknowledge that the right of withdrawal is lost once the service has been fully performed or digital content delivery has begun.
These Terms are governed by Italian law. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Italian courts. If you are a consumer, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms at any time. We will notify you of material changes via email or an in-app notice at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
